    Tenancy fraud

    Tenancy fraud is not new – but in recent times social landlords have had to do significantly more and more to tackle the problem. So what is it, exactly? Does it mean fraud at application? After the granting of the tenancy or lease? At the end of the tenancy or lease? Or all three?

    As awareness of the supply and demand equation has grown, many housing providers have become more proactive with regard to tenancy fraud. This has run in parallel with the need to become more customerfocused and to find out more about occupiers via customer profiling or tenancy audits. The commercial need to find out more about occupiers has also become more focused since the Welfare Reform Act.

    Delegates will learn about:

    • The provisions of the Prevention of Social Housing Fraud Act 2013
    • The imperatives to tackle tenancy fraud
    • The many preventative options
    • The risk assessment indicators and how to implement them into everyday operational work
    • The most common areas of fraud – succession, sub-letting, unauthorised occupation
    • Ways to tackle evidential and proof problems and sharing information with other agencies
    • The old remedies such as possession and newer alternatives such as the Fraud Act 2006.

From 1991-93 he was senior research officer at LSE Housing, and has worked for short-life and supported housing agencies, mainstream housing associations and local authorities. He is a freelance housing law specialist with 20 years’ training and development experience undertaking educational training, consultancy, policy and procedure health checks. He specialises in housing law updates, dealing with anti-social behaviour effectively, preventing and controlling rent arrears, do-it-yourself possession proceedings, the law in supported housing and the law on disrepair and best practice.

    Working effectively with hoarders

    Hoarding is a very complex condition and can have a massive impact on the tenant, the property, the landlord as well as neighbours. Sometimes it’s a mental illness, sometimes a type of neglect. It can be caused by various other complex factors. Understanding hoarding and the tools available is a must. 

    Hoarding is not against the law but the damage it can cause often breaches tenancy agreements, Public Health legislation and could even be a safeguarding issue. Hoarders need to be identified as quickly as possible and support offered – or in extreme cases enforcement action taken. There are many types of support – de-cluttering and therapy, behavioural contracts, SMART monitoring. Hoarders must be properly assessed using appropriate and accredited tools.

    This course will explore all the recognised options that are available to staff working with hoarders as well as help organisations to create policy procedures and protocols. It will look at the role of housing professionals as well as how health or social care specialists can assist.

    You will learn:

    • About hoarding disorder and its possible causes
    • About OCD, including causes, prevalence, symptoms and links to hoarding
    • And be given the tools to help identify and work with hoarders
    • To understand and be able to categorise different types of hoarders using a validated screening tool
    • To understand how to work effectively and creatively with hoarders using proven methods and recognised techniques

    Tenancies and licences

    In English law, there are some 15 different kinds of tenancy, all with different names, all with different rights and responsibilities and, since the Localism Act 2011, there are minimum two-year fixed-term flexible and affordable rent tenancies. Many people only have a licence (personal permission) to occupy. Confusion reigns and mistakes are all too common when creating, managing and terminating these occupation agreements.

    This training will provide a clear understanding of the different kinds of tenancy/licence and how to minimise errors.

    • What a ‘licence’ is and who should really have a tenancy
    • Who should get what kind of agreement when first occupying
    • The need for accurate and clear written and verbal agreements with occupiers

    Michael Guest is a well-established and sought-after consultant and trainer in housing. His expertise and experience extends across the housing sector, with specialisms in Governance and Resident Engagement. He is known for his highly professional, yet relaxed and approachable working style that lends itself in particular to learning and development assignments. This is combined with working comfortably at political and governance levels, through executive, management and operational staff and with involved residents and communities.

    After holding a number of senior management positions in housing, Michael has for the last 26 years been Director of Michael Guest Associates Ltd., providing consultancy and training to the sector. A key aspect of this work is as part of HQN programmes since its inception.

    Michael is a Chartered Housing Professional, Chartered Management Consultant and Chartered Manager. A Fellow of the Chartered Institute of Housing he is a:

    • Regular Chair of and Lead Assessor on its Direct Finals Professional Interview Panels
    • Registered CIH Mentor for Senior Housing Professionals
    • Member of the Housing Academy, including as a trainer and as an Housing and Property Management Apprentices' Associate.

    Rent First: Positive conversations to maximise income, help people and prevent homelessness

    Landlords and customers are having to adjust to the many changes arising from Covid-19 and the “new normal”.

    This virtual workshop – delivered over Zoom on two consecutive mornings (10.00am to 13.00pm) – explores the new challenges for housing providers working hard to maximise income and support customers. Some customers will be new to claiming benefits, others will be facing greater financial pressures as a result of lockdown and social distancing, many will be vulnerable and need extra support.

    The practical workshop will examine the skills that are needed for any negotiating situation bringing together proven techniques and strategies for effective negotiation, motivational interviewing and debt management.

    Although focused on housing income management, the tips and techniques are fully transferable to other areas of work as well as participants’ personal lives.

    Why “Rent First?”

    When our financial circumstances change, one of the most pressing concerns is how to meet our housing costs. This is true for most social housing tenants.

    “Rent first” is not about landlords taking an unduly hard line with tenants but simply reflects that this is a high priority for both parties and the starting point for positive conversations.

    What will delegates learn?

    These workshops will boost participants’ knowledge and confidence in:

    • Initiating and managing positive conversations
    • Instilling a payment culture with empathy
    • Handling objections assertively and engaging customers in finding solutions
    • Negotiating payment plans and motivating changes in payment behaviours
    • Helping customers to pay on time and to manage their accounts successfully.

    Tony studied psychology and philosophy at the University of Stirling and maintains an active interest in communication and behavioural science. He incorporates the latest thinking on these subjects into his work.

    He has extensive experience in designing and delivering highly effective negotiation training workshops and development programmes, across a range of sectors and in a variety of contexts. These include specialist workshops focused on housing management.

    As an HQN associate, Tony designed HQN’s income management and financial inclusion toolkits and helped to develop the accreditation service for income management. He leads the specialist Rent Income Excellence Network and carries out regular “hands-on” service reviews and health checks on rent collection and arrears management.

    He has a track record of supporting clients to improve performance in challenging environments and has practical experience of managing complex projects that have delivered improved social and financial outcomes.

    Tony has written a number of papers and presented at many conferences on the subject of income maximisation, debt recovery and financial inclusion. He has a keen interest in the opportunities to improve quality and value for money through better integration of housing, social care and health services and more effective engagement with customers and communities.

    Tony is a member of the Chartered Institute of Housing, Chartered Institute of Credit Management, the British Institute of Learning Disabilities, the Project Management Institute and the Financial Health Exchange, for whom Tony is a member of the Advisory Panel.

    He is an associate lecturer at the University of Salford where he designs and leads on the University’s Introduction to Housing Policy and Practice blended learning degree module and is an associate of the University’s Sustainable Housing and Urban Studies Unit.

    Tony Bolder has over 27 years’ experience (operational and safety roles) within the Fire and Rescue Service (FRS) and over 30 in the fire sector. As a previous operational support manager for Humberside Fire & Rescue Service, Tony was instrumental in developing operational readiness for over 300 firefighters including high rise incidents, chemical spills and road traffic collisions.

    On leaving the fire service, Tony set up his own Fire Risk Management consultancy and, taking the same professional attitude into the private sector, he is now one of only around 60 UKAS third-party accredited life safety fire risk assessors listed on the FRACS register (and also the NAFRAR list) and one of only a handful of professionals who are also third-party accredited fire door inspectors, through both FDIS and NAFDI.

    FDIS Certificated Inspectors are uniquely qualified to undertake fire door inspections, not only have they achieved a Diploma in Fire Doors, but they have also had their competence and knowledge independently assessed to become CertFDI certificated fire door inspectors. In addition, NAFDI Members ensure that all fire door inspections are carried out in accordance with all statutory requirements and hold industry recognised.

    Whilst rent arrears are always hitting the press, many organisations spend hundreds of thousands of pounds on providing services. But few recover the full costs from their tenants and leaseholders. Councils are raiding the HRA to balance the general fund.  Lets stop this by getting on top of your service charge setting and collection!

    This practical workshop will assist you in maximising your income: we will provide working examples of how to calculate the real cost of providing services, how to identify where full recovery is not being made and how to bridge the gap. For developing organisations, we will highlight the critical path to ensuring full recovery of costs, including an exercise in how to calculate service charges when developing new schemes for rent and sale, to ensure that you have considered everything.

    Jackie Dickins has been an HQN Associate since 2001 and is our lead consultant for HQN’s Leasehold Network. Prior to this she held positions at a London borough and two large housing associations based in London, where she was responsible for leasehold management and promoting work in the field of low-cost home ownership initiatives. Jackie undertakes many of HQN’s service reviews and service improvement work on leaseholder and home ownership.     Motivational interviewing

    Motivation is the most important factor in changing behaviour. Some service users won’t appear to have any motivation; others will, but not always necessarily for the right things, like for example paying rent or taking medication. To empower these service users to change their lives, you need to be able to help develop their motivation.

    Motivational interviewing helps to develop a service user’s internal motivation to change ‘problematic’ behaviour of every kind. It is an effective and easy-to-learn technique, that helps you to develop skills such as open questioning and reflective listening to enable you to draw out motivational statements from the service user, allowing them to realise how important change is, and empower them with the confidence to carry out and then to maintain change.

    • What motivation is and how you can measure it 
    • To understand external motivation: the carrot-and-stick approach 
    • To explore Internal motivation and how it’s developed 
    • To understand the vital role of importance and confidence in internal motivation

    The UK anti money laundering regime has evolved over a number of years and includes legislation intended to counteract criminal money laundering and terrorist financing.     Tony Bolder has over 27 years’ experience (operational and safety roles) within the Fire and Rescue Service (FRS) and over 30 in the fire sector. As a previous operational support manager for Humberside Fire & Rescue Service, Tony was instrumental in developing operational readiness for over 300 firefighters including high rise incidents, chemical spills and road traffic collisions.

    On leaving the fire service, Tony set up his own Fire Risk Management consultancy and, taking the same professional attitude into the private sector, he is now one of only around 60 UKAS third-party accredited life safety fire risk assessors listed on the FRACS register (and also the NAFRAR list) and one of only a handful of professionals who are also third-party accredited fire door inspectors, through both FDIS and NAFDI.

    FDIS Certificated Inspectors are uniquely qualified to undertake fire door inspections, not only have they achieved a Diploma in Fire Doors, but they have also had their competence and knowledge independently assessed to become CertFDI certificated fire door inspectors. In addition, NAFDI Members ensure that all fire door inspections are carried out in accordance with all statutory requirements and hold industry recognised.

    Tony is passionate about education, providing courses accredited by the Institute of Fire Safety Managers (IFSM) and is a national speaker on fire safety for a number of networks, a contributor to the BBC, Sky News and CNN International and he is often heard providing professional comments on LBC radio.

    Tony studied psychology and philosophy at the University of Stirling and maintains an interest in communication and behavioural science, which he incorporates into his work.

    Tony designed Housing Quality Network’s income management and financial inclusion toolkits and leads on HQN’s unique accreditation service for income management. He has conducted many improvement projects and inspections and has a track record of supporting clients to improve performance in challenging environments.

    Tony is a member of numerous professional and representative organisations. These include the Chartered Institute of Housing, Chartered Institute of Credit Management, the British Institute of Learning Disabilities, the Project Management Institute, the Housing Studies Association and the Financial Health Exchange.

    Since 2011, Tony has been a visiting lecturer and tutor at the University of Salford and is an associate of the University’s Sustainable Housing and Urban Studies Unit.

    Sustaining and managing a tenancy: mental health, mental capacity and hoarding

    Mental health and hoarding are often major contributory factors in people being unable to maintain tenancies. Early identification and support are vital, delivered by housing staff with an awareness of these ever more common, and often difficult to manage conditions. 

    Many people who suffer from mental illness or hoard have problems managing their tenancies. They may develop arrears, cause problems to neighbours or be at risk because of their own vulnerabilities. Properties may become unsafe or squalid; access can be difficult, whether for yearly gas checks or other routine inspections; tenants may refuse to maintain properties or allow improvements by the landlord. 

    This course is for all staff working with people whose mental health may impact on managing their tenancies, including hoarders. It will provide an overview of common mental health issues and will focus on tenancy sustainment/enforcement options relating to mental health and hoarding. It will link this to the Mental Capacity Act 2005 and explain how mental capacity is vital in modern day tenancy sustainment/enforcement. 

    We will explore: 

    • Common mental health issues, including hoarding, and how these can impact on tenancy management 
    • The Mental Capacity Act 2005 and how capacity should be used when exploring either sustainment or enforcement options 
    • The importance of early identification of mental health or hoarding issues via appropriate assessment 
    • Practical ways to engage, develop a rapport with, and motivate tenants with mental health or hoarding issues 
    • The need for an effective risk management system and common risks when working with mental health and hoarding cases 
    • Using case studies, options for tenancy sustainment and enforcement 
    • Relevant legislation including the Care Act 2014.

    Danny McGowan BSC, MSC has been involved in supporting people with substance misuse, mental health and other complex needs for over 20 years.     Non-technical staff are increasingly being asked to undertake inspections of void and tenanted properties. This course will provide guidance on how to do them effectively, with a focus on the customer perspective.

    Delegates will also learn how to conduct estate/area walkabout inspections in a knowledgeable and effective manner, with an emphasis on issues such as protecting the housing stock, identifying areas for future investment, health and safety, and compliance with legislative requirements.
